Once a party makes a decision to get a divorce, their attorney will file a petition for divorce in a family law court and serve the petition on the other party. The petition will state the reason for the divorce, usually that the marriage cannot continue because of conflict between the parties, and that there is no reasonable expectation that the parties can resolve their differences.

The parties may engage in discovery, which can include depositions and requests for documents. After discovery, the parties may mediate and try to resolve their differences without a trial.  If the parties reach a settlement, then an Agreed Decree of Divorce is signed and submitted to the judge for approval.  If mediation is not successful, then a judge will rule on spousal support, division of property, child custody, and child support.
