At some point in our lives we all begin thinking about the future of our estate.  A will is designed to protect your family and property after you pass.  It gives you the opportunity to distribute your property, establish care for your children, and express your wishes upon your death.  If you die without a will, there may be significant chaos and discord regarding what happens to your estate.  A will helps to bring order to that process, so that your family can grieve your passing without having to navigate Texas’ intestacy laws.

Our will package contains five important estate planning documents.  These documents are prepared by our attorneys just for you.  We offer an affordable flat fee, meaning we do not work on an hourly rate, and you know the cost before you hire us.

We Prepare Your Will Package

Once you hire our firm, we will send you a questionnaire.  The questionnaire contains all the information we need to prepare your will package.  Once you have completed your questionnaire, we will prepare your will package, and send it to you for your review and approval.

Signing Your Will Package

Once your will package is completed, it is time to execute (sign and making it legal) the documents.  You can either come to our office to execute your will or we will provide you with detailed instructions on how to do it yourself in your own home.

Should I consider a trust instead of a will?

In some cases trusts are a better choice, but for most people a will is a better option.

  • The main benefit of a trust is avoiding probate. But in Texas, there are ways to avoid most of the cost of probate. Many types of property can be transferred from a family's estate to family members without the need of probate.
  • Married couples can agree in writing that community property will go to the surviving spouse when one person dies. This is called a right of survivorship. Joint tenancy property or real estate can also be passed with a right of survivorship. Bank accounts can be made payable-on-death to a spouse. Life insurance policies and retirement accounts can include beneficiaries.
  • The cost of maintaining a trust for many years can be expensive. A will usually does not require costly maintenance, meaning the lifetime cost of having a will instead of a trust may be much lower. Also, wills do not require that you transfer ownership of your property to another entity (as with trusts).
