Chapter 7 Bankruptcy
Chapter 7 bankruptcy is for debtors without the means to pay creditors. The purpose of a Chapter 7 case is to eliminate debt. After successful completion of the case the debtor receives a discharge. The discharge is a court order that permanently shields the debtor from liability for many types of debts. This means that the creditors discharged in the case are no longer allowed to collect the debt from the debtor. Chapter 7 cases take four to five months to complete.
Chapter 13 Bankruptcy
Chapter 13 bankruptcy allows debtors to protect secured property and reduce their debt. Debtors in these types of cases file a plan to reorganize their debt. The plan states that the debtor will make payments to a trustee each month for thirty-six to sixty months. The trustee takes the money and pays it to the creditors as per the terms of the plan. Plan payments are based upon the debtor’s ability to make payment. The purpose of Chapter 13 cases is to allow debtors to reorganize their debt in an affordable way.
